1. Agreement to these terms
These Terms & Conditions (“Terms”) are an agreement between you and TelevisitMD (“TelevisitMD,” “we,” “us”). They apply when you visit this website, contact us, are referred to us as a patient, use our services, or refer a client to us. If you do not agree, do not use our website or services.
As a patient, you will also sign onboarding documents, including a Letter of Protection. If a signed onboarding document conflicts with these Terms, the signed document controls for the subject it covers.
Please read section 11 (Financial terms) carefully. It explains that you remain financially responsible for the services you receive, even though you pay nothing upfront.
2. What we do
TelevisitMD coordinates telehealth medical evaluations for people injured in motor vehicle accidents, slips and falls, and other personal-injury incidents (the “Services”). The Services include:
- signing your forms electronically;
- a secure online health questionnaire;
- a telehealth evaluation by a licensed healthcare provider (“Provider”);
- medical records, referrals and, where appropriate, prescriptions; and
- preparing your bills and records (your “records package”) and sending them to you and your attorney.
In these Terms, “Patient” means a person who receives the Services (or their parent, guardian or personal representative), and “Referring Firm” means the attorney and law firm that refers a Patient and represents them in their personal-injury claim.
3. Not for emergencies
THE SERVICES ARE NOT EMERGENCY CARE. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.
Do not wait for a telehealth evaluation if you have chest pain, trouble breathing, loss of consciousness, repeated vomiting after a head injury, new or worsening weakness or numbness, numbness in the groin or inner thighs, loss of bladder or bowel control, or fever with back pain. If your answers show symptoms like these, your case will be escalated for urgent in-person care, but that does not replace calling 911.
4. Telehealth care and its limits
Telehealth lets a Provider evaluate you remotely using the information you provide and, where scheduled, a live audio or video visit. It has limits: a Provider cannot perform a hands-on physical examination and may not be able to observe everything an in-person visit would reveal. Your Provider may decide that telehealth is not appropriate for you and recommend in-person care instead.
Your evaluation depends on the accuracy and completeness of what you report. The Services supplement, and do not replace, care from your primary care physician and any in-person care you need.
5. Licensed providers and clinical independence
Clinical services are provided by physicians and nurse practitioners who are licensed in the state where you are located at the time of your evaluation. Providers exercise their own independent professional judgment. We do not direct or control their clinical decisions, and no referral relationship, claim or request from any party influences what a Provider diagnoses, recommends or signs.
We use decision-support software and AI-assisted tools to organize information and draft documentation. These tools do not make clinical decisions: a Provider reviews and signs every clinical document. We do not guarantee any particular diagnosis, finding, referral, imaging study, prescription or treatment.
6. Eligibility and accurate information
To receive the Services, you must:
- be at least 18 years old, or have a parent or legal guardian complete onboarding and consent for you where the law permits;
- be located, at the time of your evaluation, in a state where an available Provider is licensed;
- be represented by an attorney for the personal-injury claim related to your injuries; and
- have a working mobile phone number or email address, and internet access.
You agree to give truthful, accurate and complete information about your identity, the incident, your symptoms and your medical history, and to update us if it changes. Inaccurate information can lead to inappropriate care and inaccurate records. We may decline or stop providing Services if information is false or misleading.
7. Onboarding documents and electronic signatures
Before any clinical activity, you must sign four onboarding documents, sent by email and/or text message for electronic signature:
- Letter of Protection (LOP) — Lets you get care now with no upfront payment. Your bill is paid from your injury settlement or judgment through your attorney.
- Consent to Treatment — Your agreement to be evaluated and treated by video visit, including what video visits can and can't do.
- HIPAA Authorization — Lets us send your medical records and bills to your attorney so they can support your case.
- Patient Disclaimer & Acknowledgment — Confirms you understand that video visits are not emergency care, how prescriptions work, and how your bill is handled.
Consent to electronic records and signatures. You agree to receive documents and notices electronically and to sign them electronically, and that your electronic signature has the same legal effect as a handwritten one under the federal E-SIGN Act and applicable state law. You need a device with internet access, a current web browser, and access to your email or text messages. You may request a paper copy of any signed document at no charge, and you may withdraw your consent to electronic records by contacting us — but because our Services are delivered electronically, withdrawing may mean we cannot continue.
If an onboarding document is declined, voided or left unsigned, we cannot provide clinical Services.
8. Medical intake, scheduling and follow-up
- After you sign your forms, we send you a secure link to a health questionnaire. Keep your links private — anyone with the link could open it. Links may expire.
- We send reminders if your intake or documents are not completed. If they remain incomplete after our reminders, we may pause or close your case and notify your Referring Firm.
- If a live visit is needed, you will receive a link to choose a time. If you miss an appointment, contact us to reschedule.
- Your Provider may require a follow-up visit. Follow-up visits may be needed before referrals are renewed or a prescription refill is issued.
9. Prescriptions
- No controlled substances. Providers do not prescribe or refill controlled substances, including opioids, through the Services.
- Initial fill plus at most one refill. Any prescription is limited to an initial fill and no more than one refill.
- Follow-up first. A refill will not be issued while a required follow-up visit is outstanding.
- Whether to prescribe is entirely the Provider's decision. Prescriptions are sent to a pharmacy, which sets its own prices; pharmacy charges are separate from our charges unless we tell you otherwise in writing.
10. Referrals and third-party providers
Your Provider may refer you for chiropractic care, physical therapy, orthopedic or neurology evaluation, behavioral health, diagnostic imaging, durable medical equipment or other care. Referrals are recommendations; you decide whether to follow them. Providers and suppliers you are referred to are independent of us and responsible for their own services, terms and charges. We do not control and are not responsible for their care, and we do not receive any payment for referring you to them.
11. Financial terms: Letter of Protection and liens
No upfront payment. Services are provided on a lien basis under the Letter of Protection (“LOP”) you sign. You do not pay at the time of service.
Billing. Our charges are listed on an itemized bill that we send to you and your attorney. We bill your Referring Firm for your case only after your Provider has signed your medical records.
Payment from your recovery. Under the LOP, you authorize and direct your attorney to pay our charges directly from any settlement, judgment, award or other recovery on your claim, before the remaining funds are disbursed to you.
You remain financially responsible. Unless your signed LOP states otherwise, you are responsible for all charges for Services you receive, whatever the outcome of your claim — including if the claim is denied, dismissed, abandoned, or resolved for less than the total of your bills, or if you change or discharge your attorney. In those cases, the charges become payable by you directly when we notify you.
Keep us informed. You agree to tell us promptly if you change attorneys, if your claim is resolved or dropped, or if you file for bankruptcy.
Charges from other providers, pharmacies and suppliers you are referred to are billed by them under their own terms.
12. Terms for attorneys and referring firms
By referring a Patient, the Referring Firm agrees that:
- it represents the Patient in the personal-injury claim, has the Patient's permission to make the referral and share their contact details, and the referral information it provides is accurate;
- it will not send medical records or other health information through our website contact form, and will use our designated referral channels;
- it will honor the Patient's LOP: protect our charges from any recovery, withhold the amount due before disbursing funds, and pay our invoice from the proceeds promptly upon resolution;
- it will notify us promptly in writing if it withdraws or is substituted as counsel, or if the claim is resolved, dismissed or abandoned, and will provide the name of any successor counsel;
- it will use the records we provide only for the Patient's claim, safeguard them appropriately, and not re-disclose them except as the Patient authorizes or the law permits;
- it will not attempt to influence any Provider's clinical findings, diagnoses, referrals or documentation. Records reflect the Provider's independent judgment and will not be changed at any party's request, except to correct a factual error through our records-amendment process; and
- no fee, rebate, gift or other compensation is paid or received by either party for referrals. We do not pay for referrals and do not accept payment for referring Patients to anyone.
Records and acknowledgments. We send the Patient's records package to the Patient and the Referring Firm by tracked email, which provides a time-stamped record of delivery. We ask the Referring Firm to acknowledge receipt and its awareness of the lien. This acknowledgment is for notice only: it never delays the Patient's care, and not acknowledging does not affect the validity of the LOP or the lien.
Invoices. Invoices are issued to the Referring Firm after a Provider signs the Patient's clinical note. Please raise billing questions promptly by contacting us. We do not provide legal advice and are not a party to the attorney–client relationship.
13. Your medical records
Your Provider signs your medical records electronically. We then send your records package to you and, under your HIPAA Authorization, to your attorney. We may ask you to confirm that you received it and that you know about the lien.
You have the right to access and request amendment of your records as described in our HIPAA Notice of Privacy Practices. We do not guarantee that your records will support any particular legal position, claim value or outcome.
14. Communications
By giving us (or allowing your attorney to give us) your email address and phone number, you agree that we may contact you by email, phone and text message about your care, forms, appointments, records and billing. These communications are part of the Services. Email and text messages are not fully secure; we send links to secure pages rather than including health details where possible. Text messages are governed by the SMS Terms below.
15. SMS / text messaging terms
Program. TelevisitMD Patient Notifications sends care-related text messages to patients who are referred to us, such as links to your forms, appointment reminders, and updates about your care and records. We do not send marketing text messages.
Consent. You agree to receive these messages when you, or your attorney with your permission, provide your mobile number to us for your care. Consent to receive text messages is not a condition of receiving the Services — you can ask us to contact you by email instead.
- Message frequency varies depending on your case and how quickly each step is completed.
- Message and data rates may apply. Check your mobile plan for details.
- To opt out, reply STOP (or END, CANCEL, UNSUBSCRIBE or QUIT) to any message. We will send one message confirming your opt-out and then stop texting you. Reply START to opt back in.
- For help, reply HELP, call (470) 369-0476 or email hello@televisitmd.com.
- Mobile carriers are not liable for delayed or undelivered messages.
- Some messages may be sent on our behalf by one of our service providers; replying STOP to those messages stops messages from that sender.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
16. Privacy
Our Privacy Policy and HIPAA Notice of Privacy Practices explain how we collect, use, share and protect your information, and are part of these Terms.
17. Use of this website
Content on this website is general information about our Services. It is not medical or legal advice and does not create a provider–patient or attorney–client relationship.
You agree not to:
- use the website or Services for any unlawful, fraudulent or misleading purpose;
- submit false information, or information about another person without authority;
- attempt to access accounts, links, records or systems that are not yours, or interfere with their security;
- use automated means to scrape, overload or disrupt the website; or
- copy, modify or distribute our content, logos or trademarks without permission.
The TelevisitMD name, logo and website content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable right to use the website for its intended purpose.
18. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR GUARANTEE ANY MEDICAL RESULT OR THE OUTCOME OR VALUE OF ANY LEGAL CLAIM.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TELEVISITMD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or willful misconduct, or any Provider's professional responsibility for the clinical care they provide.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TelevisitMD and its personnel from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the website or Services, your violation of these Terms, or — for a Referring Firm — its breach of section 12.
21. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules, except where the law of the state where you received care must apply.
Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you and we consent to their jurisdiction. This does not limit your right to file a complaint with a government agency or licensing board.
22. Changes and termination
We may update these Terms by posting a new version with a new “Last updated” date. Changes do not alter onboarding documents you have already signed. We may suspend or stop providing the Services if you breach these Terms, if continuing would be unsafe or unlawful, or if a Provider determines telehealth is not appropriate for you. Sections that by their nature should survive — including financial terms, Referring Firm obligations, disclaimers and limitations — survive termination.
23. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, together with your signed onboarding documents, our Privacy Policy and our HIPAA Notice, are the entire agreement between you and us about their subject.
