1. Who we are and what this policy covers

TelevisitMD (“TelevisitMD,” “we,” “us”) coordinates telehealth medical evaluations for people injured in motor vehicle accidents, slips and falls, and other personal-injury incidents. Patients are referred to us by their attorneys, evaluated by licensed healthcare providers, and receive care on a lien basis under a Letter of Protection.

This Privacy Policy explains how we collect, use, share and protect information when you:

  • visit this website or contact us through it;
  • are referred to us as a patient and receive care through us;
  • are an attorney, law-firm staff member or other professional who works with us; or
  • receive emails or text messages from us.

By using our website or services, you acknowledge this policy. Our Terms & Conditions also apply.

2. How this policy relates to HIPAA

Health information that identifies you and that we create or receive in providing care — your intake answers, clinical notes, diagnoses, referrals, prescriptions and bills — is protected health information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”).

How we use and disclose PHI, and your rights over it, are described in our HIPAA Notice of Privacy Practices. If anything in this Privacy Policy conflicts with that Notice regarding PHI, the Notice controls.

This Privacy Policy also covers information that is not PHI, such as information you submit through our website contact form and technical data about website visits.

3. Information we collect

Information you give us

  • Identity and contact details: name, date of birth, sex, mailing address, email address and mobile phone number.
  • Claim details: the date and type of incident, how the injury happened, and the name, firm and contact details of the attorney handling your claim.
  • Health information: your symptoms, injuries, medical history, medications, allergies and other health details you share with us or your provider, including answers about your emotional health and sleep.
  • Signatures: your electronic signatures on the forms you sign with us, and your confirmation that you received your records.
  • Communications: what you send us by phone, email, text or our website form, including business contact details from attorneys and other professionals.

Information from your attorney or referral source

When an attorney refers you, they give us your name, phone number, email address, incident details and their own contact information so we can open your case and reach you.

Information from providers and partners

The licensed providers who care for you create your medical records, such as visit notes, diagnoses, referrals and prescriptions. Other providers and pharmacies involved in your care may also send us information about your treatment.

Information collected automatically

  • When you visit our website: basic technical information, such as your IP address, browser and device type, the pages you visit and when.
  • When you use our services: records of when you open, sign or complete the forms and links we send you, so we know where your care stands.

4. How we use information

We use information to:

  • open and manage your case and link it to the attorney who referred you;
  • contact you by email, text message and phone about your forms, appointments, care and case;
  • allow licensed providers to evaluate and treat you and create your medical records, referrals and any prescriptions;
  • coordinate referrals to specialists, imaging centers, equipment suppliers and pharmacies;
  • prepare your bills and records, send them to you and — with your permission — to your attorney, and get paid under your Letter of Protection;
  • protect your safety and the accuracy of your records, including directing you to in-person care when your symptoms are urgent;
  • respond to questions and requests, including website inquiries;
  • operate, secure, troubleshoot and improve our website and services, and prevent fraud and misuse; and
  • comply with law, respond to lawful requests, and establish, exercise or defend legal claims.

We do not use your health information for marketing without your written authorization, and we do not sell personal information.

5. How we share information

We share information only as described here, as described in our HIPAA Notice, or with your permission:

  • Licensed providers who evaluate and treat you, and the medical practice and records systems they use.
  • Your attorney and law firm. Under the HIPAA Authorization and Letter of Protection you sign, we share your medical records, bills and case status with the attorney handling your claim. Information disclosed under an authorization may be re-disclosed by the recipient and may no longer be protected by HIPAA. You can revoke your authorization in writing at any time, except to the extent we have already relied on it.
  • Other healthcare providers you are referred to — such as chiropractors, physical therapists, orthopedic and neurology specialists, behavioral-health providers, imaging centers, medical-equipment suppliers and pharmacies — for your treatment.
  • Service providers who help us operate, under written contracts that require them to protect the information and use it only for our services — including, where they handle health information, HIPAA business associate agreements. They include providers of secure forms and electronic signatures, medical records, messaging, secure hosting, billing and documentation tools (see section 7).
  • Legal and safety reasons: when required by law, court order or subpoena; to report suspected abuse or neglect; for public-health and health-oversight purposes; to prevent a serious threat to health or safety; or to protect our rights and the rights of others, as permitted by law.
  • Business transfers: in connection with a merger, acquisition or sale of assets, subject to legal protections for health information.
  • With your consent or at your direction.

We do not sell your personal information, and we do not share it for cross-context behavioral or targeted advertising.

6. Text messages (SMS)

We use your mobile number to send care-related text messages, such as links to your forms, appointment reminders and updates about your care. Message frequency varies with your case. Message and data rates may apply. Reply STOP to opt out or HELP for help. Full program terms are in our SMS Terms.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in this policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

Text messages are not a secure channel for detailed health information. We send links to secure pages rather than putting health details in a text, and we ask you not to text us medical information.

7. Automated tools and AI-assisted documentation

We use software, including AI-assisted tools, to organize the answers you give us and prepare draft documents for your provider.

These tools do not make clinical decisions. A licensed provider reviews and signs every medical document, and all diagnoses and treatment recommendations are the provider's own. The companies that run these tools use information only on our behalf.

8. Cookies, analytics and tracking

This website does not use advertising cookies, social-media pixels or cross-site tracking technologies. It uses only what is strictly necessary to deliver and secure the site, and our hosting provider keeps standard server logs.

We do not place advertising or analytics trackers on the pages where you give us health information.

Because we do not sell or share personal information for targeted advertising, there is nothing to opt out of; we nonetheless treat a Global Privacy Control signal from your browser as a valid opt-out request. If we add analytics in the future, we will update this policy first.

9. How we protect information

We use administrative, technical and physical safeguards designed to protect information, including:

  • encryption in transit (TLS) and encryption at rest through our hosting and storage providers;
  • role-based access, so staff see only what their job requires;
  • secure links to forms and appointments that expire;
  • activity records for every case; and
  • written agreements with service providers that handle PHI.

No system is perfectly secure. If a breach affecting your information occurs, we will notify you and the authorities as required by law.

10. How long we keep information

We keep medical records for at least as long as medical-records laws in the applicable state require, and longer while a claim, lien, payment or legal matter related to them remains open, or when the law requires us to preserve them. Billing and accounting records are kept as tax and accounting laws require. Website inquiries are kept as long as needed to respond and maintain reasonable business records.

When information is no longer needed, we delete it or de-identify it.

11. Your choices and rights

  • Your health information: you have the right to access and get copies of your records, ask us to correct them, get an accounting of certain disclosures, ask for restrictions and confidential communications, and more. See Your rights in our HIPAA Notice.
  • Revoking your HIPAA Authorization: send written notice to our Privacy Officer. Revocation stops future disclosures to your attorney but does not undo disclosures already made, and may affect our ability to provide services on a lien basis.
  • Text messages: reply STOP at any time. We will continue to contact you about your care by email.
  • Other personal information: you may ask to access, correct or delete information that is not PHI, such as website inquiries. We may need to keep some information to meet legal obligations.

To make a request, email hello@televisitmd.com, call (470) 369-0476 or write to the address in section 16. We will verify your identity before acting on a request, and you may use an authorized agent or personal representative where the law allows. We will not discriminate against you for exercising your rights.

12. State privacy rights

Depending on where you live, state law may give you additional rights over personal information — for example, to know, access, correct, delete or port it, and to opt out of its sale, of targeted advertising and of certain profiling. Many of these laws do not apply to PHI governed by HIPAA, which is covered by our HIPAA Notice.

Some states, such as Washington and Nevada, also protect “consumer health data” that is not covered by HIPAA. Where those laws apply, we collect and use such data only to provide the services you request, we do not sell it, and you may request access to or deletion of it.

You can exercise any of these rights as described in section 11. If we deny your request, you may appeal by replying to our decision; if you remain unsatisfied, you may contact your state attorney general.

13. Children's privacy

Our services are intended for adults. If a minor receives services, a parent or legal guardian must complete onboarding and consent on the minor's behalf where the law permits. This website is not directed to children under 13, and we do not knowingly collect personal information from them through it. If you believe a child has sent us information through the website, contact us and we will delete it.

14. Third-party sites and services

Some steps in our process, such as signing forms and answering health questions, take place on secure pages run by our service providers on our behalf. Other websites we link to are governed by their own privacy policies, and we are not responsible for their practices.

15. Changes to this policy

We may update this policy from time to time. We will post the updated version here with a new “Last updated” date, and if a change is material we will give additional notice, such as by email or a notice on this website, before it takes effect.
